Child Safe undertakes, for a period of 3 years from the date of installation, to repair or replace (in its sole discretion) all or part of any fence which becomes unfit for the use for which it was intended as a result of a manufacturing defect in the textile material, the aluminum or fiberglass posts or other materials used. Defects of a purely esthetic nature are, however, excluded from this warranty.
Child Safe warrants the installation of the fence for a period of 3 years from the date of installation and undertakes to repair any defect in installation which renders the fence unfit for the use for which it was intended.
Although the Child Safe fence is designed to resist normal winter conditions, Child Safe cannot warrant the fence and its installation against the consequences of excessive snow cover, the weight of which may exert excessive pressure against the fence.
Child Safe cannot warrant the fence and its installation against the consequences resulting from uneven or unstable ground surfaces and the consequences resulting from the freeze and thaw of the ground.
The purchaser and user of the product shall be solely responsible for inspecting the fence periodically and reporting any damage to its materials to Child Safe and must take any and all precautions required in order to prevent and minimize any damage or deterioration of the fence.
If testing and inspections by Child Safe demonstrate that the fence has been subjected to abnormal concentrations of oxygenated water, chlorine or other oxidizing products, misused, cut or otherwise abused, the present limited warranty as well as any other warranty, express or tacit will be deemed null and without effect.
Child Safe in its sole discretion will determine in any particular case whether the fence has been misused or abused or if it is unfit for the use for which it was intended. The present warranty replaces any other warranty, express or tacit concerning the product and is only valid for the original purchaser and is not transferable.
